Rarely do we ever write about the music industry here at FV, but this specific case will be an exception, only because this is a case of an entire media company denying a wrong that it has done, especially to a very talented composer like Gary Granada.
Songwriter and Composer, Gary Granada, was given lyrics which he was supposed to translate into music. This music would ultimately be used by GMA for a Kapuso foundation media campaign. But, GMA ended up not using Gary Granada, but it seems that they used his musical creation in the end, and basically ditched Gary and gave him nothing at all, not even a claim on the work itself, because as GMA says, Gary’s work was a “collective” work.
Now Gary, maintains if GMA is allowed to get away with this, it is tantamount to the theft of his creative work. Now, here is Gary making his case. Listen for yourself.

Gary’s version is actually cuter.
A few months back, i came across this Seed Magazine article on the underlying mathematics behind Music. Gary Granada’s technical exposition is the clearest example of this that i have come across. Shame on GMA!
Gary can go to court and prays that his case is raffled to an honest judge to vindicate the injustice done to him or go to court just the same even if it goes to a corrupt judge because the result will validate that the perception that the Court is indeed corrupt. In the first situation he wins, in the second situation, the public wins because the case will generate much interest seeing a good case ditched because he was up against a powerful institution.
The third situation is the possibility that GMA might stike up a deal and enter into an amicable settlement. This would still be a win for him.
But first get a good lawyer.

I’ll have to take Paul Bucheit’s position on this: Gary Granada’s copyright on his song was INFRINGED but GMA KAPUSO did NOT STEAL anything. STEALING and COPYRIGHT INFRINGEMENT are two different things. Gary Granada should be given ALL ROYALTIES DUE HIM!
I think it’s a no-brainer. They sent him lyrics without notes. He gave them back a complete song. It’s a no-brainer they officially version used his work. The finished product itself becomes a collaboration. He should get paid.
GMA should prove they sent the other composer the lyrics only. They should take a leaf from Hollywood. Hollywood pays hundreds of thousands for treatments alone and they may use several treatments till the finished screenplay. Everyone gets paid.
COPYRIGHT INFRINGEMENT or STEALING, for me, kahit anong term pa iyan, in Filipino it is still PAGNANAKAW. Look, when you STEAL, you have no intention of returning it back, when you INFRINGE, you violate the underlying contract, GMA used the song without any approval and acknowledgment from the owner, so they INFRINGED, but we are talking of intangible thing here, and as if we can return it back as if saying, “Pahiram ng composition mo, ibabalik din namin sa iyo”, and the way of returning should be proper compensation and acknowledgment, which GMA never did. So what they did is TANTAMOUNT to STEALING.
Mindanaoans are behind Gary!
I support Gary. Actually I believe na dapat parusahan na ‘yang GMA. Aside from the GARY Granada issue na ‘yan. Meron pang ibang issue na dapat i-tackle sa malalaking media outfit na ‘yan.
Una ay ‘yung pag focus nila sa pagkakaroon ng malaking kita. Nawawala na sa kanila ‘yung public service. Oo nga at my Kapuso foundation sila but i guess promotion lang ‘yun. Plastikan lang kumbaga.
Ang ikalawa ay ‘yung abuso nila sa mga viewers. Grabe, mas mahaba ‘yung airtime ng patalastas kesa sa palabas kaya inaabot sila ng madaling araw. Marahil kaya ganoon ay dahil sa wala namang masyadong content ang mga shows nila.
I am neither kapuso nor kapamilya, I just want to comment on what you’ve said na mahaba ang patalastas, since I get to watch both of the stations’ shows, I think pareho lang sila… the reason is maraming sponsors/advertisers na gusto dun sa slot na un sila ipakita simply because madaming nanonood. iyon lang naman. thank you!
So, the copyright hawk FILSCAP could not do anything against the media behemoth GMA? :P
Eventually GMA may just opt to “resign” from the FILSCAP board, not out of honor but out of its own interests. Just like what it did a few years back with KBP, when the maximum ad airtime issue was hot.
I have a theory about it, I think the execs thought changing the melody alone would be effectively changing the composition. Oh were they wrong! I wrote about it on my blog too.

Sasakalin nila sa mga detalye at ligalidad. Gagamitin nila ang dambuhala nilang makinarya na kayang-kayang umabot sa mas madaming mata at pandinig. Ako po’y nangangamba para sa inyo sapagkat sadyang malaki ang binabangga sa labang ito. Subalit mas ibayo ang saloobing pagpagsuporta. Naway madami pang makarinig sa iyong paliwanag. Naway madami pangmaabot ng katotohanan sa likod ng usapin.

Maybe the case of George Harrison’s “My Sweet Lord” and The Chiffon’s “He’s So Fine” can clarify more about this cause of Mr. Granada. The songs of G. Granada and GMA are really more similar than those of Harrison’s and The Chiffon’s.

GMA may be a giant company, but the public supports Gary Granada all the way.
Sana ay hindi mawalan ng saysay ang ipinaglalaban ni Ka Gary. Though how many times na magbigay ng statement ang GMA na “inosente” sila, hinding hindi na maibabalik ang pangwawalang hiya nila sa isang talentadong singer-songwriter na katulad ni Gary Granada.

GMA is now obviously using its clout in the print media plane…showbiz columnists are already starting to pick up the issue , at least from the tabloids that we are daily being churned out with…jaryogroups in ME, but expectedly, they are blatantly carrying the lines of defences of GMA…kadiri..!!!
OFWs can easily relate with ka gary,..he is someone who won’t go a mile just so he can make a step for his trade and commercial gain. The radicalism of ka gary’s messages embraces much of the angst of OFWs struggles, the ennui in our loneliness ..away from home and family..
WE can only choose between the 2 giant networks for our tele link sa inang bayan..
Unless GMA make good with its defense or maybe, choose the path of humility in accepting the damage done to ka gary, we are mulling over the idea of runnning a boycott of GMA here in Gitnang Silangan..starting in Qatar..

babae.

May isang bata na nakatira sa bukid. Wala siyang laruan maliban sa cellophane o
plastic na pinapalipad nya sa hangin.
Minsan, napag-isipan ng batang ito nag awing guhit puso ang plastic upang maging
isang magandang lobo. Pagkatapos ay ipapalipad niya ito sa hangin.
Kaya tinalian nya ang ibang bahagi ng plastic para maging guhit puso. Bandang
