    In short, the question revolves around whether or not Gaite, in the context of this proviso, possesses good moral character.

Your defenses of her and the FG are admirably restrained and often point out legal interpretation of various things. But such defenses often lack moral conviction, thus lack the power to convince.

    Your high fees are of course to be congratulated. But they are really non-sequitur here. We do not need them to take the measure of you or appreciate it for what it is.

    Gaite admitted giving 500,000 to JLO, yes? So, what Buencam and all the rest are saying is quite obvious—we don’t need an operator over at the SEC. What we need are people with the highest integrity so that we’ll be able to conduct our affairs in the highest order.

    I don’t fault you for not having the proper and wholistic perspective of things happening here. What is happening during these past months is simply, a moral revolution.

    The perception being created is that it’s not enough for you to be qualified. What we need are people who are qualified and who are incorruptible. Integrity is a requirement for public office.

    Gaite may be qualified, but there are obviously others more qualified than him, yes? What’s so bad about this appointment is Arroyo appointed someone, a bureaucrat and a known operator, to sit as a regulator of business. This appointment is akin to a mayor appointing his bribe collector to the permits section.

    GMA did not reappoint Martines because of allegations that he took a bribe from De Los Angeles.

    GMA appointed Gaite to replace Martinez despite allegations that the P500,000.00 he gave ZTE NBN witness Jun Lozada was for Lozada to stay away from the Philippines while the ZTE NBN hearings were going on.

    essentially, bribery is committed when a public officer is paid to do or not to do an act, or to perform or not perform his duties. even granting, arguendo, that gaite gave the 5k, that alone cannot suffice to establish a probable cause.
