Pulis,

PWE!!!!

Just common sense... If you are in the stupid mayor or their dimwits bodyguards position, are you going to hit a 14 yr old boy?

This is just a clash of 2 boastful families.

And still, that is not an attitude of a government official saying "KILALA MO BA KUNG SINO AKO" and hurting a kid.

PWE to those BOASTFUL FAMILIES
HAAAKKK PWEEE!!!!!

atty,

kindly read between the lines. what is the final case against the pangandamans? SLIGHT PHYSICAL INJURIES! he was mauled. that is webster's word. sa libro ni luis reyes, sa annotations lang yan, wala sa code.

if the force used by the pangandaman to repel the attack of the de la pazes was excessive, e di sana, hindi SPI ang kaso. si fortun pa, di makakita ng paraan?

kung tingnan ang injuries ng mayor, mas malala pa kaysa kay bino kc may fracture sya e.

eto arguments ko about sa "kid":

http://ph.news.yahoo.com/star/20090111/tph-valley-golf-club-kicks-out-brawlers-541dfb4.html

pulis,

While de la paz instigated the fight, he was still mauled. And as our law would have it, the method of "self-defense" must be commensurate to repelling the attack.

If de la paz was already down on the ground, the unlawful aggression had already ceased and thus, any more "defending" is no longer covered by self-defense.

So what can (should) we learn from all of these? Better to get all sides of the controversy before we shout our lungs (cyber lungs though) out.

I give those that shouted injustice some benefit of the doubt. Nadala lang sila ng emotions and were motivated by good intentions.

Although, the road to hell is strewn with good intentions.

i wonder what is the next thing that the de la paz apologists will say, now that valley golf expells Dela Paz and only suspends for two years the dar chief.

valley golf concluded that de la paz instigated the fight!

As a lawyer, i always distrust "personal" accounts. Specially since these accounts vary due to perspective and interest. Moreso, I doubt what my client says until i see evidence and/or if its personal account vs. personal account, on who is more believable. But ofcourse, i fight for my client's right to best of my abilities and to the full extent of what the law allows me to.

Since I wasnt there I can only go with instinct and that is, the truth is almost always, somewhere in the middle.

But this doesn't mean that no criminal, civil or administrative liabilities exist. Specially with public servants (i actually dislike using this title) since they are supposedly held to a higher degree of responsibility.

If we take the account of the Mayor's camp as true, he did not act in the manner that he's supposed to. If he felt aggrieved, he should've had the man arrested or he could've effected a citizen's arrest as provided in the Rules of Court. Well, i dont think he would've since it was his companion that threw the first punch after the umbrella poking incident.

On an aside, i find it amusing when i hear/read how rich people fight. Meron pang pasundot-sundot ng payong. Ano yun? And the thought of my Mom wielding a knife to offer me "resbak" is totally unimaginable. All this with her broken family and daughter of a fishvendor in the morning and fruitvendor in the afternoon upbringing.

While I come from the lower middle class due to my father's profession (he's a lawyer too), we grew up almost poor. We lived beside the largest squatter's colony in Metro Manila, Welfareville. And because i spent most of my waking time in the squatter's colony, I witnessed some really great fights. One group from one "looban" (iskinita) would have a "rumble" with another group from another "looban".

These people would bring out bolo's, fan knives and "pana's" (this is constructed more like a "tirador"/slingshot with a sharpened nail as a projectile). But after the initial hits (which are mostly misses actually), it would cresendo into a volley of rocks being hurled and which would subside to an invective shouting and threat making match.

But not all fights were fought this way. There would be times where to settle things, fisticuffs or "square lang" would be resorted to. I can vividly remember the father of my squatter kababata. He was a brawler that duked it out with a "karatista".

The karatista was leading until the brawler, while getting hit, was able to close the gap and grapple him down on the pavement. Just like your olden striker-vs-grappler matches in the UFC albeit more crude and the protagonists, ugly and more than usual, drunk. Mind you, this was fought along the busy two-way street of Nueve de Febrero in Mandaluyong when it still shared an intersection with Shaw Blvd so this fight literally was a roadshow with stopped traffic and pedestrians and commuters watching and cheering.

Baseball bat and a knife? Have any of you tried to swing a baseball bat in a fight? Baseball bats are only good for smashing cars and hitting unknowing targets. Give me a foot long lead pipe and I'll fight a guy weilding a full bat anytime.

Damn, my "squatter" or in them golfer's terms, "skwating" or "skwaking" upbringing is getting the better of me.

I thought the intended suit between members of Manila Polo Club because of badminton courts was stupid... Here comes one for the books.

Lessons learned for me: Dont play golf. Never poke someone with an umbrella. AND, never sound off on an alleged injustice until i hear both sides of the story.
