In the widely televised House Committee on Drugs hearing today, three things were established. First, the PDEA led by the courageous Marine Mayor Ferdinand Marcelino conducted the Ayala Alabang buy-bust operation according to plan. They conducted a pre-arrest investigation. They cased the suspects. Eventually, they were able to entrap them thru a buy-bust operation. Based on the report, Richard Brodett, son of popular golf icon, “Butch” Brodett was the head of the group composed of Joseph Ramirez Tecson and Jorge Jordana, son of Johnny “Midnight” Joseph Jordana. When these drug pushers were interrogated, PDEA found how Brodett got his illegal drugs from abroad. They followed procedures. Surprisingly though, the prosecutors who handled the case, Senior State Prosecutor Philip Kimpo and the one who penned the resolution,Joseph Resado did not see it that way, and it was affirmed by Chief State Prosecutor Jovencito Zuno who even defended the DOJ position before the media.
By the way, the ponente, Prosecutor Resado admitted having been a student of the Alabang boy’s lead counsel, Atty. Felisberto Verano Jr. who is now under water for allegedly trying to wiesel his way out of a rejection to release his clients by Justice Secretary Raul Gonzales.
Atty. Verano, incidentally, is also a fraternity brother of DOJ Undersecretary Ric Blancaflor (the frat name is the Order of Utopia, a law fraternity of the Ateneo de Manila school of Law) whose name was dragged into this case after allegedly calling up Major Marcelino of PDEA for a followup. The House committee decided to call Atty. Verano after they found out that Atty. Verano reportedly tried to do a fast one when he allegedly gave an envelope containing a draft release order to the secretary of his frat brother, Undersecretary Ric Blancaflor who, in turn, immediately went to the office of the DOJ secretary Gonzales for him to sign the draft release order. It seems that, according to Cong. Roilo Golez, there was an “irregularity” here since allegedly Atty. Verano used a paper with the DOJ official logo when he reportedly made the release order. One other Congressman (I think it was Gen San Lovely Darlene Antonino insinuated that that act was a violation of the Code of Professional Ethics of lawyers).
Second, the bribery attempts did take place, according to Major Marcelino. He was reportedly pressured by JoTec, a relative of one of the suspects and even his own PMA Class 1994 mistah. Marcelino made us all proud when he resisted all attempts at releasing these high-society drug peddlers.
Lastly, it seemed that, based on the hearing, there are certain procedural aspects that both the DOJ and the PDEA should resolve. That’s why the Dangerous Drug Board, headed by former Senator Tito Sotto recommended that a prosecutory unit be created within PDEA that will try all these drug cases.
IN all these, let the wheels of justice grind against these scums of the earth. PR operators are moving right now in the media to mitigate the effects of these revelations, but, their attempts will be put to naught. The truth will come out. These devils who sell these illegal drugs should be put to death, whoever they may be.
And, for the first time, I would like to commend Philippine president Gloria Macapagal-Arroyo for standing her ground on this one. It is highly commendable, even heart-warming, to hear Mrs. Arroyo even calling Justice Secretary Raul Gonzales and ordering him not to release the Brodett-Tecson-Jordana drug trio, pending review of the resolution. For all our differences in opinion before, this one, I salute President Gloria Arroyo.
To Major Marcelino and General Santiago–sirs, the Filipino People salute you. May your tribe increase. May you continue your fine work. For our idealistic brothers in PDEA, sirs, continue to do the good work for and on behalf of the Filipino People. We salute you sirs. Let the revolution continue and fight these evil menace that inflicts our nation.

And ever since the Subic Bay Rape Case, the matter of “midnight releases” has been tightly controlled by the Palace, or at least monitored by the Executive Secretary. Remember too, how “PMA Classmates” played such a big role in the mysterious beginnings of the Oakwood Mutiny. The use of influential shysters like Atty. Verano is also reminiscent of tactics used during the J-LO affair.

Who has’nt heard of the name Richard Santos Brodett, the alleged head of one of the biggest drug groups in high society Manila? A resident of Acacia Street, many residents of A yala Alabang hate Richard Brodett’s guts. Ever since his transfer from Merville Paranaque to Ayala Alabang Muntinlupa, Brodett reportedly is a known black sheep. That’s according to some sources over at the exclusive village. Brodett reportedly caused a mayhem when he transferred home.
Reports say that Brodett, Joseph Tecson and their accomplice, Jorge Jordana Joseph, son of Johnny Midnight, came to know each other early of 2006 when they started going on the night club and bar circuit.
These trio belong to a bigger drug syndicate reportedly controlling the high society drug trade in Metro Manila and Baguio. They reportedly organize concerts and use these events or gigs as one way to sell their drugs. And boy, they allegedly sell ecstacy, cocaine and shabu.
A lawyer once remarked that’s its impossible for these alleged “boys” to do what the PDEA accused them of doing. A source told that these suspects are not exactly “boys”. They are adults and they belong to the druggie world dominated not only those living in Alabang. These drug crazy addicts and peddlers are sons and daughters of high society living in Valle Verde, Pasig and New Manila.
Sources over at PDEA said, it’s just a matter of time before government agents crack these drug organisation. A tip to the PDEA–this drug syndicate is being controlled by the son of a retired General. Question–will PDEA really have the balls to arrest the 169 Drug Club based in Valle Verde Pasig?

It keeps the fire burning inside us lowly citizens to still hope and wish for a final solution to end the hopeless inequality of social gap between politicians and government officials on one side and ordinary citizens on the other. Short of a nationwide revolt where Filipinos are just waiting for the lone Dark Angel to lead and cause an overwhelming tide to erase these evil bloodsuckers who, instead of spending peoples’ taxes for the improvement of their living conditions, their safety and security and the construction/repair of infrastructure for faster delivery of services, pocket the money in the form of SOP, commission and other illegal means only a brave Jun Lozada was able to tell the people and spend these money to have their family and their relatives enjoy a luxurious lifestyle, ask Satan in Hell to help them create devilish office memos and orders to justify on paper the release of funds in their favor while ordinary citizens are left to grit their teeth in anger and hunger.

I don’t buy the PDEA’s story. The DOJ was right to dismiss the case.
How can the PDEA have followed procedure when they don’t even have an operations manual on buy busts?
You watched the hearings, you must have seen Rep Teddy Casino ask the PDEA lawyer if they had such a manual and all the lawyer could say was that other buy busts have resulted in convictions, there was jurisprudence etc. But he never said the PDEA had a buy bust operations manual.
The reason why so many cases get thrown out is because our cops don’t know how to effect busts without skipping due process and all that.
What the PDEA needs to do is to educate their agents on proper legal procedures.
Good intentions are no substitute for strict adherence to due process and the rule of law. Law enforcers should always remember that they are agents of the law not the law unto themselves.
And Director Dionisio Santiago…well he’s a cop in the Mayor Alfredo Lim mold.

PDEA agents are composite forces from AFP and PNP. To generalize them as powder-keg mentality is an insult to the men in uniform who are putting their lives on the line just so you can live a peaceful existence!!
I came from these organization and you have no right to throw insults when you haven’t been in their shoes yet.
At the very least, General Santiago did not exhibit any healthy sense of respect for the rule of law in this country.
He must leave the case to the prosecutorial role of courts since where implementing the law ends, the prosecuting job begins and that is no longer within his province.
Santiago as echoed by Marcelino did not believe that bribery did not take place down to the fiscal level on most drug cases. Why does he have that as a mindset or worldview? They don’t trust our justice system, how can that be?

My view as a former drug victim (Alabang Boys and Parents)
I watched this morning the Alabang parents of so called “alabang boys” on morning show TV, I can’t help but sympathized with them. I remember when I am a heavy user of drugs that this so called “law enforcers” twisted the law.
They witch hunt heavy drug users (heavy users means lots of money in the pocket) not to change them to recovery but to extort money from them. I was victimized not “once but twice” by this people and I could see this people are not concerned for me to change from my twisted ways but compliment them by giving them a “tax money” so I would have a “licence to used drugs.” I could still vividly recall a so called police enforcers telling me after this bati-bati na tayo (after this “caught and bribe me” scheme or the HULIDAP we are now friends).
I can believe this “Alabang parents” that they received a suggestion from these law enforcers that they want 3M “pizza” or mullah? Sadly that time, I have give in to the bribe and give myself a painful reality that nobody could help me but myself to change, with Gods guidance and mercy I was led to recovery. No thanks to these law enforcers that they have opened my mind, not to depend for their “evil concocted help” but only stopping that vice could save me from leading me to bribe them again because that’s what their definition of law enforcement all about. This is a sad reality but true.

Fact 1–There is always an operational manual. Every enforcement agency has one, and that includes PDEA.
Fact 2–These Alabang adults were nabbed with 60 ecstacy tablets and all sorts of drugs. Johnny Midnight admitted it. Even the lawyer admitted it.
So, what is not to be believed in their story? Even our friend and colleague Leah Navarro commended the PDEA for this. At least, for this one, let’s give praise to these honest men and women of the uniformed services who are doing their duty to God, Country and People.
What’s important my friend is they are doing their best according to the mandate given to them. They do their jobs, period. And they do it excellently, Let’s not deprive them at least of this one.

I do not question the magdalo boys’ integrity. I do have some doubts about the respect of Dir Santiago for due process and rule of law. Once again I refer you to his statement in Palo Leyte last Ma.
Chong, the issue of alleged tainted evidence should have been an issue for judicial review based on the supposedly prevailing system of criminal law copied from the Kano. The law enforcers work with the prosecutors in establishing probable cause for filing a complaint. It is supposed to be adversarial with the foot soldiers working with the prosecutors.
Throwing out alleged tainted evidence is not the job of the prosecutors in this particular case when there are may have been extraneous circumstances behind the discovery.
Not withstanding any idiotic statements made by Santiago which have nothing to do with the appreciation of evidence during the process for establishing probable cause.
Notwithstanding the perception of most people on the capabilities and integrity of most of the law enforcers of the land this dismissal clearly smells.
One of the men fled and had to be chased down. The discovery of additional evidence should have been properly logged and once again this was an issue for a judge to determine not a probable rookie prosecutor who was made the probable fall guy for the higher ups.
It is noteworthy that MB said that the “cops” may have crossed the line on the proper arrest procedures and proper collecting of evidence.
That may have been better decided by a sitting judge. (also theoretically)
Now that the shit may have hit the proverbial fan lets us see where it will fall.

The prosecutors in this country, just like in the US, have to decide whether or not they have a winnable case to take to court. In the US you see prosecutors working closely with law enforcement officers to build a strong case.
The point is the prosecutor, whether here or in the US, must be convinced that he has a good case before he takes it to court. In the case of the Alabang Boys the prosecutor felt that he had no chance of winning because, based on the affidavits of the PDEA agents themselves, there were flaws in the operation.
Thus to submit the proposition that the issues tackled by the prosecutor was better left to the judge is to put the cart before the horse.

when PDEA was created thru RA 9135, it was specifically mentioned in Article IX that the Board should formulate a Standard Operating Procedures. I don’t know if this equates to operating manuals though..

With your comment, I can sense that you are a former military officer who can vouch for the integrity of Santiago while in SOCOM (whatever that meant). I just suspected that he must be a general and therefore not trained in the workings of law in the context of due process.
Pretty much like Major Marcelino, I would like to believe since he is member of the Marines and when you say one is member of the Marines, it is entirely something else. They are not called Marines for nothing.
Well then, PDEA must have obviously been over-militarized. It is time to inject a new breed of lawyers as field agents and operatives much like in NBI. The more educated our agents are, not necessarily in pure military education, I think would be better. That’s just an option for now given than in both the AFP and PNP, they always top the list of human rights violators.

And you said Santiago, like Alfredo Lim are men of integrity. Well, you must have heard of so-called dirty dozen in NBI when Lim was director and hope you’ll be kind enough to tell me how they go about certain cases. Spray painting alone, to me, is already keenly unconstitutional.
It is high time we don’t repose the mandate of PDEA to either active or retired officers of the AFP or PNP. And if I must suggest, better leave it to those with fine academic background in law, public administration, business, et cetera.
We must realize that the training one derives in the PMA or other like academies, them having been patterned after the US Military Academy is not one suited for a job like PDEA.
I don’t as much as think we need combat-trained military officers for the work since drug cases must satisfy strict legal requirements.
Until PDEA chief learns not to short-cut the law, then it is best.
I’m just sure of one thing, RFI has been overused by Prosecutors who dwell on technicalities rather than intelligently, applying the same doctrine of judges and justices, reading the merits and demerits of the case. Prosecutors WORK WITH enforcement agencies NOT WITH defendants/suspects. Probable cause is the primordial concern and not the preparation of the case.
See, law is based on logic. It’s the courts discretion to kill or the use the evidence gathered. If you let prosecutors use the excuse of stronger evidence, cases should’ve been tried in the DOJ rather than the courts.
For sure if these…KIds or boys as what the parents and Lawyer of this “kid-selling and kid-using drugs” want to call them, were from poor family nobody will touch this case from these famous personas.Even Blancaflor nor the media will not focus attention to this case.

It is so alarming that people can be so free with their accusation here and the press who was once restrained under martial is now so sensational. Whatever happened to responsible reporting?
One must read the extra-ordinary mandate of PDEA to fully understand the unconstitutional power they already have. (It is easily assessable on the internet.)
Given that, they should have no problem making their case/s stick UNLESS :
1. They use untrained trigger happy addicts turned agents (balet ulo system) who are just out to avenge their personal issues and score points with head counts (see the PDEA website, recruiting campaign and informant rewards);
2. Or, they have the WRONG mind set (“open fire” by Gen. Santiago) and that the power of their mandate has gone to their heads thereby they refuse to adhere to the already compromised human or constitutional rights, (required procedure of their buy bust mandate) of the individual to be charged;
3. And then, the most deadly possibility of all is that with their refusal to adhere to the rules and procedure of their very own mandate, they are purposely filing defective cases as an invitation to bribery. (Chair Sotto says, “Most of the dismal of drug cases are due to the non appearance of the arresting agents.”)
It should be said that Pdea ‘sets the stage’ by planning the entrapment and they call all, if not most of the shots. Why then does implementing the plan (they have all the power, the arms, and the information) flap, when all they have to do is follow it?
Prosecutor Resado should be the man of the hour. Resado did not sway in spite of the unacceptable way he was grilled by so called educated men.
The congressmen, oh my God, what a show! They were all grabbing their 15 minutes claim to fame. The congressmen present in that hearing are all clowns, fame grabbing clowns, none of them got to the main issue of bribery. No proof was given to the bribery. They asked a question and could not wait to hear the answer. Each time Resado would come up for air (in between sentences) they would put words in his mouth.
Shame on the clowns and the ‘crying Major’. THE MAJOR WAS NOT EVEN PRESENT IN THE SO CALLED ‘BIG SYNDICATE BUY BUST’ IN ALABANG. The Major obviously has major problems controlling his temper. He truly showed his true colors when he was questioned by Gonzales.

I know that there is a State prosecutor named Philip Kymko a good man living within the means, and a state prosecutor named John Resado with too many coincidences surrounding his Bank accounts, I think he looks good pushing a wooden cart out on the street, not as an under cover bloke, but as a regular, I mean just look at this face. The drug menace is a world wide epidemic, I will not buy anyone portraying themselves as “heroes” that can bring it to an end. There are many at PDEA who work in the shadows, really making a dent with what little they have, they are overwhelmed, but they are professionals. No one is perfect, and that goes with organizations.
Maj. Ferdinand Marcelino is an outstanding infantry officer and a good marine with an impressive combat record. I would like to see him in command of an MBLT now.
Golez like Santiago belongs to class 70. Almost the same as Verano being a fraternity brod of Usec Blancaflor. The difference is in the agenda. As to what it is, I leave that as you’re home work if you like.
It is hard to prove the “he said, I said” argument

A man before World War II was a multi-millionaire.
He earns millions of dollars per year. He has
some businesses. One of it is a tailor shop. The
tailor shop earns millions of dollars per year.
And the customer, is himself only, the owner.
The government investigators cannot find and
nail him for any wrong doing.
This is a true story:
The man is Alphonso Capone, the Big Boss of the
Mafiosi in Chicago, Illinois, U.S.A.
He ran a good Mafia Syndicate, involving: illegal
gamblings, prostitutions, gun runnings, protection
rackets, loan sharkings (a la Resado’s five-
six), illegal bars, union bustings, etc…
He is a good bribers of politicians, government
officials, and other people who got on his way.
People loved him. Because he gave them fun and
pleasures.
He was finally indicted on Tax Evasion. He served
jail until he died.
Any similarities to what I have told as story is
purely incidental. There is no motive on the story teller to cast aspersion to anybody’s
character or integrity.
